YOUR ACTION IS REQUESTED—NSA NEEDS YOUR COMMENTS ON POSSIBLE CHANGES TO CIRCULAR 230


The U.S. Treasury has issued an advanced notice of proposed rule making regarding practice before the Internal Revenue Service under Circular 230. Some of the issues Treasury wishes to explore include:

  • Broadening the scope of who may practice before the IRS—Should licensed accountants who are not CPAs be allowed to practice before the IRS? Should the definition of practice be modified so that an unenrolled return preparer is a practitioner under Circular 230?
  • Changing the Enrolled Agent Designation—Should Enrolled Agents be allowed to refer to themselves as "Licensed Tax Professionals" or another specified designation?
  • Advertising—Should regulations set forth acceptable descriptions of practice for advertisements?
  • Sanctions and disciplinary proceedings—Should disreputable conduct regulations be amended?
  • Contingent fees—Should contingent fees be allowed in certain circumstances?

    Given the broad implications of this notice, your input is important to help NSA develop comments that reflect the interests of the membership. Are You Ready for Tax Season? Taxes are the focus of the December 2002/January 2003 issue of the NPA. Individual articles deal with travel expense deductions, tax-filing status; treatment of foreign taxes at the state level and taxability of IRA transfers. There’s an overview of federal taxation enacted in 2002 and an edited version of a report on IRS progress in changing its image and mission to that of service. Regular columnists discuss teamwork in the workplace and offer 10 marketing tips to start 2003 off the right way. Don’t miss two new regular features: the Message from President Krieger (on page 8) and the roundup of NSA Association News. Finally, a special insert contains the Exposure Draft of the Tax Accounting Standards for Small Business. Comments on these are due by January 17.
